Terms of Service

These terms of service govern your use of KinderCompass, the parent application owned and operated by KinderLogix. KinderCompass is provided to parents and guardians by the childcare centre their children attend. By accepting an invitation to KinderCompass, or by signing in, you accept these terms. If you do not agree with them, please stop using the application; your childcare centre will continue to serve you directly as before.

1. Your Account

KinderCompass is available to adults whom a childcare centre has authorised to see a child's information. Children do not have accounts. Your centre decides who is invited, which children an account may see, and what that account may do, and KinderLogix acts on the centre's instructions in those matters. If the centre withdraws your access, or your child leaves the centre, your access to that centre's information ends.

Your account belongs to you alone. Choose a password that you do not use elsewhere, or register a passkey on your device, keep your sign-in secure, and do not share it with any other person, including within your own family. If two parents each need access, ask your centre to invite each of you. Please tell KinderLogix at once if you believe someone else has used your account.

2. Personal Information

KinderLogix collects and handles personal information in accordance with its Privacy Policy, and in compliance with Canadian privacy law. The Privacy Policy forms part of these terms and explains what is collected, why, who it is shared with and how long it is kept.

3. Use of the Application

You agree to use KinderCompass only for your own family, and not to:

• attempt to reach another family's information, or any part of the application you have not been given access to;
• copy, scrape or bulk-download information, or access the application by automated means;
• interfere with the application, its security or another person's use of it, or test its security without written permission from KinderLogix;
• upload or transmit anything unlawful, harmful or malicious, impersonate any person, or harass any member of staff or any other family;
• use the application to break any law, or for any commercial purpose.

KinderLogix may suspend or end access that breaches these terms, and will inform your childcare centre when it does.

4. Information From Your Childcare Centre

The children, attendance, schedules, fees, invoices, calendar, staff profiles and family contacts shown in KinderCompass are records kept by your childcare centre in its own system. The centre enters and controls that information and is responsible for its accuracy. KinderCompass displays it; KinderLogix does not decide what it says. If something appears to be wrong, please contact your centre, which can correct it at the source.

Three points follow from this:

• KinderCompass is not an emergency service. Never use it to report an emergency, a late pick-up, an absence that matters today, or anything concerning a child's safety. Telephone your centre.
• Information viewed offline may be out of date. Pages you have already opened remain readable without a connection and are marked as offline. They are a copy taken at your last visit.
• Your centre's records govern. Where your centre uses check-in by QR code, checking in through the application records attendance in the centre's system, and you must still follow the centre's own sign-in rules. Where a payment link appears, the payment is taken by your centre's payment provider and not by KinderLogix; questions about an amount, a discount, a subsidy or a refund are for your centre.

5. Information You Provide

You may edit your name, your profile photograph, your contact details and the contacts on your family's file, where your centre permits it. What you save is written to your centre's records. Please keep it accurate and keep it to your own family. Do not upload a photograph of another person's child, and upload only a photograph you have the right to use. KinderLogix may remove content that breaches these terms or that your centre asks it to remove.

6. Intellectual Property Rights

KinderCompass, and all intellectual property in it, belongs to KinderLogix. You may not copy, modify, distribute, reverse engineer or create derivative works from any part of the application, separate its graphics from their accompanying text, or obscure any copyright or trade mark notice. The records displayed to you belong to your childcare centre and are shown to you for your own family's use.

7. Third Party Material, Linked Websites and Email Communications

KinderCompass may link to websites operated by others, including your centre's payment provider and the application stores. KinderLogix does not control those websites and is not responsible for their content or their handling of your information.

KinderLogix sends you only the messages the service requires: your invitation, verification of your email address, password resets and notices about your account. These are service messages rather than marketing, and they are sent to the address your centre holds for you.

8. Availability of the Application

KinderLogix works to keep KinderCompass available but does not promise that it will always be available, uninterrupted or free of faults. The application may be taken down for maintenance, and features may be changed, added or removed.

9. Ending Your Use and Deleting Your Account

You may stop using KinderCompass at any time. You may delete your account from the Profile page in the application, or through the account deletion page if you can no longer sign in. Deleting your account removes your sign-in and the personal information held for it. It does not delete your child's records at the centre, which the centre keeps under its own licensing and record-keeping obligations. The Privacy Policy sets out what is deleted and what is kept.

KinderLogix may suspend or end your access if you breach these terms, if your childcare centre asks it to, or if the centre stops using KinderCompass.

10. Limitation of Liability & Disclaimer

KinderLogix provides KinderCompass "as is". To the extent permitted by law, KinderLogix gives no warranty that the application will be available or error free, and none that the information displayed is accurate or complete, because that information is entered and controlled by your childcare centre.

KinderLogix is not liable for indirect or consequential loss, and its total liability to you in connection with KinderCompass is limited to one hundred Canadian dollars. KinderLogix is not responsible for your childcare centre's decisions, records, fees or care of your child, nor for a payment provider, an application store or your internet connection.

Nothing in these terms limits or excludes any right you have under the consumer protection legislation of your province or territory that cannot lawfully be limited or excluded.

11. Latest Versions

KinderLogix may change these terms. The current version is always shown in the application, with its version number and effective date. Where a change is material you will be asked to accept the new version the next time you sign in. Continued use of KinderCompass after a change means that you accept it.

12. General

A failure to enforce any provision of these terms is not a waiver of it. If any provision is found unenforceable, the remaining provisions continue in force. You may not transfer your account or these terms to another person; KinderLogix may transfer them to a company that takes over the service, and your rights are unaffected.

These terms and the Privacy Policy are the entire agreement between you and KinderLogix concerning KinderCompass.

13. Governing law and courts

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta. The courts of Alberta have exclusive jurisdiction, except where the consumer protection legislation of your own province or territory gives you the right to bring a claim there.
